Access and Benefit Sharing (ABS Regulation) - UN Convention on Biological Diversity - Nagoya Protocol
The Nagoya Protocol on Access and Benefit Sharing (ABS) is an international agreement that aims to achieve a fair and equitable sharing of the benefits arising from the utilisation of genetic resources or traditional knowledge associated with them. It implements the objectives of the UN Convention on Biological Diversity (CBD).
Genetic resources are defined as any material of plant, animal, microbial or other non-human origin that contains functional units of heredity, or derivatives of a genetic resource (e.g. enzymes, proteins, metabolites) with actual or potential value.
"Utilisation" can also refer to non-commercial (basic) research and/or development.
As a user of genetic resources and/or associated traditional knowledge, you as a researcher are obliged to comply with the EU ABS Regulation, otherwise research results may not be published or research material may be confiscated and you may face criminal penalties, including fines or imprisonment.
